Terms of Service

Effective Date: March 1, 2026

1. Eligibility

You must be at least 13 years old to use Wishie. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

• You are responsible for maintaining the security of your account credentials
• You may create an account using email/password, Google Sign-In, or Apple Sign-In
• You agree to provide accurate information and keep it up to date
• You are responsible for all activity that occurs under your account
• Notify us immediately if you suspect unauthorized access to your account

3. Using Wishie

3.1 What You Can Do

Wishie allows you to:

• Create and manage wishlists with items you want
• Share wishlists with friends and family via links
• Reserve items on others' wishlists to coordinate gift-giving
• Organize Secret Santa and gift exchanges
• Set reminders for birthdays, anniversaries, and events
• Add items from product URLs with automatic metadata extraction

3.2 What You Must Not Do

You agree not to:

• Use the App for any unlawful purpose
• Impersonate another person or create a misleading account
• Attempt to access other users' accounts or private wishlists
• Use automated means (bots, scrapers) to access the App
• Upload content that is offensive, harmful, or infringes on others' rights
• Interfere with the App's operation or infrastructure
• Circumvent subscription limits or free-tier restrictions

4. Your Content

You retain ownership of all content you create in Wishie (wishlists, items, images, event details). By using the App, you grant us a limited license to store, display, and transmit your content as necessary to provide the Service, including:

• Displaying your public wishlists to users who access them via shared links
• Showing your name and email to other participants in gift exchanges you join
• Storing your data on our infrastructure (Firebase)

This license ends when you delete your content or your account.

5. Subscription and Payments

5.1 Free Tier

Wishie is free to use with the following limits:

• Up to 3 wishlists
• Up to 20 items per wishlist
• All sharing and exchange features included

5.2 Wishie Premium

Wishie Premium is available as a subscription:

• Monthly: $4.99/month
• Annual: $29.99/year

Premium includes unlimited wishlists and items, price drop alerts, custom themes, and other premium features.

5.3 Billing

• Subscriptions are billed through the Apple App Store or Google Play Store
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription in your device's store settings
• Refunds are handled by Apple or Google per their respective refund policies

5.4 Free Trial

We may offer a free trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged.

6. Affiliate Links

Wishie is not a retailer and is not responsible for product quality, pricing accuracy, availability, or fulfillment. All purchases made through affiliate links are transactions between you and the respective retailer.

7. Third-Party Services

Wishie integrates with third-party services including:

• Google Firebase for account management and data storage
• RevenueCat for subscription management
• Apple and Google for authentication and payment processing
• Affiliate networks for product link monetization

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability or practices.

8. Shared Wishlists and Privacy

• When you share a wishlist, anyone with the link can view its contents
• You can make wishlists private at any time to revoke public access
• Item reservations are visible to other viewers of a shared wishlist (to avoid duplicate gifts) but hidden from the wishlist owner
• You are responsible for the information you include in your wishlists

9. Gift Exchanges

• When you create or join an exchange, your name and email are shared with other participants
• Exchange organizers can set rules and budgets; participants agree to follow them
• Wishie facilitates the random assignment but is not responsible for participants following through on gift purchases

10. Intellectual Property

The Wishie app, including its design, code, features, and branding, is owned by Baker Labs. You may not copy, modify, distribute, or create derivative works based on the App.

Product information, images, and metadata extracted from third-party websites belong to their respective owners. Wishie displays this information for your personal wishlist management only.

11. Disclaimers

Wishie is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Product information extracted from URLs will be accurate or current
• Prices displayed are accurate (prices may change on retailer sites)
• Push notifications will be delivered at the exact scheduled time

12. Limitation of Liability

To the maximum extent permitted by law, Baker Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Wishie, including but not limited to:

• Lost data or content
• Failed gift exchanges or missed events
• Inaccurate product pricing or availability
• Unauthorized access to your account

Our total liability for any claim shall not exceed the amount you paid for Wishie Premium in the 12 months preceding the claim, or $50, whichever is greater.

13. Account Termination

• You may delete your account at any time by contacting us
• We may suspend or terminate your account if you violate these Terms
• Upon account deletion, your data will be removed from our systems, except where retention is required by law or for legitimate business purposes (e.g., transaction records)

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App. Your continued use of Wishie after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Iowa, United States, without regard to conflict of law principles.
